By accessing or using our website, placing an order, or purchasing a product from us, you agree to be bound by these Terms & Conditions.
Please read these Terms carefully before placing an order. If you do not agree with these Terms, please do not use our website or purchase products from us.
These Terms are intended to operate in accordance with applicable Australian laws, including the Australian Consumer Law (ACL).
1. About ELECTRICK
ELECTRICK PTY LTD operates an online retail business supplying electric bikes, electric dirt bikes, electric motorcycles, e-mobility products, components, accessories and related products.
Throughout these Terms & Conditions, “ELECTRICK”, “we”, “us” or “our” refers to ELECTRICK PTY LTD.
“Customer”, “you” or “your” refers to any person who accesses our website, purchases products or otherwise uses our services.
2. Using Our Website
You agree to use this website only for lawful purposes.
You must not:
- Use the website for fraudulent or unlawful activities.
- Attempt to gain unauthorised access to our website, systems or accounts.
- Interfere with the operation or security of the website.
- Copy, reproduce or commercially exploit website content without permission.
- Upload malicious software, viruses or harmful material.
- Use our website to provide misleading or fraudulent information.
- Attempt to interfere with another customer’s use of the website.
We reserve the right to restrict or terminate access to our website where reasonably necessary, including where there is suspected misuse, fraud, security risk or unlawful activity.
3. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, colours, performance information and other information displayed on our website are accurate and up to date.
However, product specifications may change from time to time due to manufacturer updates, production changes or availability.
Minor differences may occur between product images displayed on our website and the actual product, including differences in colour, graphics, finishes or components.
Where a manufacturer changes a specification without prior notice, ELECTRICK may update the product information as soon as reasonably practicable.
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.
4. Electric Bike and E-Mobility Products
Electric bikes, electric dirt bikes and other e-mobility products can differ significantly in power, speed, weight, battery capacity and intended use.
Before purchasing, customers are responsible for ensuring that the product is suitable for their intended use.
Some products may be designed primarily for:
- Private property
- Off-road riding
- Recreational use
- Track use
- Closed-course environments
- Competition or motorsport activities
Not every electric bike or electric motorcycle is necessarily legal for use on Australian public roads, footpaths, bicycle paths or other public areas.
Customers are responsible for checking the laws and regulations applicable to the location where they intend to ride the product.
Purchasing a product from ELECTRICK does not mean that the product is automatically approved, registered or legal for every type of public-road use.
Where required, customers are responsible for registration, licensing, insurance, permits and compliance with applicable local, state and federal laws.
5. Customer Responsibility for Safe Use
Customers must operate products responsibly and in accordance with the manufacturer’s instructions and applicable laws.
Before using an electric bike or e-mobility product, customers should:
- Read the manufacturer’s operating instructions.
- Check brakes, tyres, controls and safety equipment.
- Ensure the battery is correctly installed.
- Use appropriate protective equipment.
- Ride within their skill level.
- Follow applicable road and off-road rules.
- Use the product only for its intended purpose.
- Keep children away from products that are not designed or approved for their age or ability.
Customers should not modify an electric bike, battery, charger, motor, controller, braking system or other safety-critical component in a way that creates an unsafe condition.
Unauthorised modifications may also affect applicable manufacturer warranties.
6. Battery and Charger Safety
Lithium-ion batteries contain significant amounts of stored energy and must be handled, charged, stored and transported correctly.
Customers must follow the manufacturer’s battery and charger instructions.
You should:
- Use the correct charger supplied or approved for the battery.
- Inspect batteries and chargers regularly.
- Stop using a battery if it becomes damaged, swollen, leaking, unusually hot or otherwise appears unsafe.
- Keep batteries away from excessive heat, water and sources of ignition.
- Use appropriate charging practices.
- Never attempt to open or repair a lithium battery unless qualified to do so.
Do not modify, disassemble or tamper with batteries or battery management systems unless authorised and appropriately qualified.
Battery specifications, charging times, range and performance can vary depending on rider weight, terrain, speed, temperature, tyre pressure, riding style, payload and other conditions.
Advertised range figures should therefore be treated as estimates rather than guaranteed real-world distances.
7. Product Modifications and Upgrades
Customers may purchase aftermarket parts, performance upgrades and accessories separately.
Where customers modify a product after purchase, they are responsible for ensuring that the modification is safe and complies with applicable laws.
Performance modifications can affect:
- Speed
- Power output
- Range
- Battery temperature
- Motor temperature
- Braking performance
- Handling
- Component lifespan
- Warranty coverage
- Road legality
ELECTRICK is not responsible for damage caused by improper installation, incorrect use, incompatible components or unauthorised modifications, to the extent permitted by law.
This does not affect any rights a customer may have under the Australian Consumer Law.

ELECTRICK cannot guarantee that a product purchased from Australia will be legal for road use or otherwise approved for use in another country.
13. Returns, Refunds and Consumer Guarantees
ELECTRICK complies with the Australian Consumer Law.
Australian Consumer Law provides consumers with certain consumer guarantees when products are sold. These rights may include remedies such as repair, replacement or refund where applicable.
These statutory rights are separate from any voluntary warranty offered by a manufacturer or ELECTRICK.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify rights that cannot legally be excluded, restricted or modified under Australian law.
Our separate Refund & Returns Policy explains our returns process.
If you believe a product has a fault or does not meet a consumer guarantee, please contact us so that we can assess the issue and provide an appropriate remedy where required.
14. Change-of-Mind Returns
Our change-of-mind return policy may differ from remedies available under the Australian Consumer Law.
Where a change-of-mind return is accepted, the product may need to be:
- Unused
- In unsaleable condition
- Complete with original accessories
- Returned with original packaging where reasonably required
- Accompanied by proof of purchase
Certain products may have additional return requirements due to their nature, size, battery restrictions or shipping requirements.
Please review our Refund & Returns Policy before purchasing.
Nothing in our change-of-mind policy affects your rights under the Australian Consumer Law.
15. Manufacturer Warranties
Some products may be covered by a manufacturer’s warranty in addition to Australian Consumer Law rights.

Where a warranty claim is required, we may request reasonable information such as:
- Proof of purchase
- Product serial number
- Photographs
- Videos showing the issue
- Description of the fault
- Maintenance or service information where relevant
Warranty assessment may require inspection or testing of the product.

- Battery tampering
- Incorrect installation
- Unauthorised electrical modifications
- Racing or competition use where not intended by the manufacturer
- Failure to follow manufacturer instructions

- Normal wear and tear
These exclusions do not remove or limit any consumer guarantee or other rights that apply under Australian law.

Certain components are consumable or wear items and may require replacement during normal use.
Examples can include:
- Tyres
- Brake pads
- Chains
- Sprockets

- Other wear components
The expected service life of these components depends on riding conditions, maintenance, rider weight, terrain and usage.

Where appropriate, we may request additional information to verify an order.
We will handle customer information in accordance with our Privacy Policy and applicable privacy laws.
27. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, products, services, website or applicable legal requirements.
